The trial for a man accused of sexual assault continued in Cranbrook Supreme Court on Thursday.
Matthew Allan Buxton is facing charges including sexual assault, attempting to choke to overcome resistance and uttering threats to cause death or bodily harm for events alleged to have occurred in October 2016.
Justice Anthony Saunders is presiding over the trial, as well as a jury of seven men and five women.
The Crown continued with its case on Thursday, introducing evidence that included testimony from Buxton’s roommate as well as playing back an audio/video statement that Buxton gave during an RCMP interview.
Early in the morning on Oct. 8, Buxton’s roommate testified he called police after he heard a loud bang against the wall in Buxton’s bedroom.
The roommate testified he heard Buxton yelling obscenities and a female voice that said he was hurting her. The alleged victim’s identity is protected by a publication ban.
The roommate testified that two police officers arrived, one within approximately five minutes, and arrested Buxton.
Crown also played a video of an interview conducted by Cst. Brad Sabo with Buxton.
In the interview, Buxton said he came home with the complainant and two friends from a bar after closing early in the morning.
Buxton told Sabo he couldn’t remember what happened after the two friends left the mobile home during the night, however, Sabo told Buxton that he was naked when he was arrested by police and that the complainant’s pants were down.
The trial has already heard testimony from the alleged victim and responding RCMP officers, and is expected to continue into next week.
